Terms of Use

The ECHO DINE Collaboratory (“ECHO DINE CoLab”) is an online system facilitating online collaboration among teams engaged in quality improvement efforts or other children’s health projects. Users of the ECHO DINE CoLab include (but are not limited to) physicians, nurses, other clinicians, managers, executives, policy-makers, educators, parents, caregivers and interested members of the lay public. 

The ECHO DINE CoLab is owned and operated by the National Institute for Children’s Health Quality, Inc. (NICHQ), a Massachusetts nonprofit corporation. These Terms of Use refer specifically to the ECHO DINE CoLab and apply to any and all information, online communications, services, text, images, video, audio files, links, or other material and content that is or becomes available on the site. NICHQ operates other websites and web-based platforms that may be covered by different Terms of Use.

By using the ECHO DINE CoLab, you agree to abide by these Terms of Use and our Privacy Policy (more fully described below), the terms of which are hereby incorporated into this agreement by reference, constituting an agreement between NICHQ and you. When we refer to ourselves as "we," "us," "our," and similar terms, we mean NICHQ, including any subsidiary we control. We may change these terms from time to time; use constitutes your acceptance of such changes.

Disclaimer of Warranties and Liability

The ECHO DINE CoLab is a resource presented for the sole purpose of helping healthcare professionals improve care for the children and families that they serve. We include a lot of information on ECHO DINE CoLab, including articles, references, tools, databases and advertising. While we hope you find the information helpful, if you are a healthcare professional you should remember that this content is not meant to serve as a substitute for your own clinical judgment. If you are a consumer who chooses to use the information on the ECHO DINE CoLab, you should not rely on that information as professional medical advice or use it to replace any relationship with your physician or other qualified healthcare professional. WE DO NOT WARRANT OR GUARANTEE THE ACCURACY, COMPLETENESS, CORRECTNESS, TIMELINESS OR USEFULNESS OF ANY INFORMATION, PRODUCTS, SERVICES, MERCHANDISE OR OTHER MATERIAL PROVIDED THROUGH NICHQ.org OR THE INTERNET GENERALLY. WE MAKE NO WARRANTY OR GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE. IN NO EVENT WILL WE BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU OR ANYONE ELSE IN RELIANCE UPON THE INFORMATION CONTAINED IN OR PROVIDED THROUGH THE ECHO DINE CoLab.

Content That You Submit to the ECHO DINE CoLab

NICHQ will treat as confidential all user-supplied materials, content, and information (including, but not limited to, documents, web page text, tools, reports, studies, comments, ratings, and postings to discussion boards). We will not share any materials, content, or information that you post with individuals outside of the ECHO DINE CoLab without your permission.

When you post a document, comment or link to the ECHO DINE CoLab, you are responsible for selecting the privacy level for that post. For example, if you post a report that is not ready to be reviewed by the public (e.g. parents and other consumers) you must indicate that the post is “Private (not visible to families)” prior to sharing. We are not responsible for any content that you post incorrectly, but we will work with you to adjust the privacy level.

If you submit or post any content or intellectual property to the ECHO DINE CoLab, you represent and warrant that your submission or posting does not infringe the rights of the owner of such content or intellectual property or any other third party. If you are a copyright owner or an agent of a copyright owner and believe that any Content on the Site infringes upon your copyrights, you may submit a notification in writing to our designated agent pursuant to the Digital Millennium Copyright Act ("DMCA") 17 USC section 512(c)(3): Katrina McCarty, Senior Manager of Operations at NICHQ, 30 Winter Street, 6th Floor, Boston, MA 02108; email: kmccarty@nichq.org.

You shall not engage in conduct or publish information which would infringe upon or injure the personal or property rights of any individual, group, or entity—including but not limited to defamation, harassment, invasion of privacy, tort, or disclosure of confidential or trade secrets. Furthermore, you shall not violate any law, treaty, or intellectual property rights protected by law (such as copyright, patent, and trademark rights). You acknowledge that the content and materials available on the ECHO DINE CoLab include intellectual property that is protected under the copyright, trademark, and other intellectual property laws of the United States and/or other countries. Such laws generally prohibit the unauthorized reproduction, distribution, or exhibition of all text, photographic and graphic (art and electronic) images, audio video, and other protected materials. The violation of applicable laws may give rise to civil and/or criminal penalties.

Furthermore, you may not circumvent, disable, or otherwise interfere with the security features of the ECHO DINE CoLab or the features that prevent or restrict the use or copying of any content. Furthermore, you may not collect or harvest any personally identifiable information from the ECHO DINE CoLab.

Privacy Policy

We pay special attention to privacy issues. You should exercise caution when deciding to disclose any sensitive information on the ECHO DINE CoLab. These uses are more fully described in our Privacy Policy. Otherwise, we recommend that you use caution when deciding whether to give out your own personal information, and that you never give out your address, phone number, date of birth or social security number. You may not give out information about an organization, a patient or another person if you do not have the express authority or permission to share that information publicly.

General

These Terms will be governed by and interpreted in the English language pursuant to the laws of the Commonwealth of Massachusetts, United States of America, without giving effect to any principles of conflicts of law. If any provision of these Terms of Use is held to be invalid, void or for any reason unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. These Terms of Use and the Privacy Statement set forth the entire understanding and agreement between you and NICHQ with respect to your use of the ECHO DINE CoLab.
